Terms of Service

Welcome to HostViewApp. These Terms of Service ("Terms") govern your access to and use of the HostViewApp website and software service (the "Service"), operated by James Godin Vacation Rental Cleaning ("HostViewApp," "we," "us," or "our"), located at 37 Bog Rd, Vassalboro, Maine 04989, United States.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
HostViewApp provides software and operational services to vacation rental property owners and managers, primarily for short-term rental properties in Kennebec County, Maine and surrounding areas. The Service includes:
- A property management dashboard;
- Scheduling, performing, and documenting vacation rental turnover cleaning visits;
- Photo capture and storage for before/after documentation;
- Custom checklists and issue reporting;
- In-app messaging between you and our cleaning operator;
- Per-job invoicing and payment processing through Stripe.
2. Eligibility
You must be at least 18 years old and able to enter into a binding contract under applicable law to use the Service. By using the Service, you represent and warrant that you meet these requirements.
3. Accounts
To use most features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete account information;
- Maintain and promptly update your account information;
- Keep your password secure and confidential;
- Notify us immediately of any unauthorized use of your account;
- Be responsible for all activities that occur under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Cleaning services
Cleaning services are provided by James Godin Vacation Rental Cleaning, a sole-proprietorship cleaning business located in Vassalboro, Maine. Each turnover is performed under the terms agreed between you and the operator at the time of property onboarding.
4.1 Scheduling
Cleaning visits are scheduled in advance through the HostViewApp portal, by direct messaging, or by automated calendar synchronization where enabled. We make commercially reasonable efforts to perform each scheduled visit on time. Schedules may be affected by weather, road conditions, illness, prior bookings, or unforeseen circumstances; we will notify you as promptly as possible of any rescheduling.
4.2 Property access
You agree to provide accurate access information (lock codes, key locations, gate codes, parking instructions). You are responsible for ensuring the operator can lawfully enter the property at the scheduled time. We are not responsible for delays or missed visits caused by inaccessible properties.
4.3 Issue reports
If we discover damage, missing items, or maintenance issues during a turnover, we will document them with photos and a written report. We are not responsible for repairing or replacing pre-existing damage; we are responsible only for issues caused by our own work, subject to the limitations in Section 9.
4.4 Cancellations
Customers may cancel a scheduled visit at any time prior to the scheduled start. Cancellations made less than 24 hours before the scheduled start may, at our discretion, be subject to a late-cancellation fee disclosed in advance.
5. Fees and payment
5.1 Per-job pricing
Cleaning fees are quoted on a per-job (per-turnover) basis, based on property size, scope, and any agreed-upon add-ons. Standard rates are disclosed at property onboarding and may be adjusted upon mutual agreement.
5.2 Invoicing
An invoice is generated automatically after each completed turnover and delivered through the customer portal and via email. Invoices are processed by Stripe, our third-party payment processor.
5.3 Payment terms
Invoices are payable upon receipt unless other terms have been agreed in writing. We accept payment by credit card, debit card, and ACH bank transfer through Stripe. Customers may opt in to automatic charging of a payment method on file.
5.4 Late payment
Invoices unpaid for more than 30 days after the issue date may be subject to suspension of service and may accrue late fees as permitted by Maine law.
5.5 Refunds
If you are not satisfied with a completed turnover, please notify us within 48 hours of the scheduled job's completion. We will work in good faith to remedy the issue, which may include a partial or full refund, a re-clean at no additional charge, or a credit toward a future visit, at our discretion.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law;
- Attempt to gain unauthorized access to the Service or its data;
- Reverse-engineer, decompile, or disassemble any part of the Service;
- Use the Service to harass, abuse, or harm another person;
- Upload viruses, malware, or other harmful code;
- Impersonate any person or misrepresent your affiliation with any entity;
- Attempt to interfere with or disrupt the integrity or performance of the Service.
7. Intellectual property
The Service, including all software, design, text, graphics, and logos, is the property of James Godin Vacation Rental Cleaning and is protected by copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during the term of your account.
You retain all rights to content you upload (such as property information and special instructions). By uploading content, you grant us a non-exclusive license to use, store, and display that content solely as necessary to provide the Service to you.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
9. Disclaimers and limitation of liability
9.1 Service provided "as is"
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
9.2 Limitation of liability
To the maximum extent permitted by applicable law, in no event shall HostViewApp, James Godin Vacation Rental Cleaning, or its principals be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service.
Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100), except where prohibited by law.
Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be limited under applicable law.
9.3 Insurance
James Godin Vacation Rental Cleaning maintains a commercial general liability insurance policy through Lloyd's of London with a $1,000,000 general aggregate limit. A certificate of insurance is available upon request. Insurance does not waive any other terms in this section.
10. Indemnification
You agree to indemnify, defend, and hold harmless HostViewApp, James Godin Vacation Rental Cleaning, and its principals from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party right.
11. Termination
You may stop using the Service or close your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.
Upon termination, your right to use the Service immediately ceases. Sections 5 (Fees), 7 (Intellectual property), 9 (Disclaimers and limitation of liability), 10 (Indemnification), 12 (Governing law), and any other provisions that by their nature should survive termination will survive.
12. Governing law and dispute resolution
These Terms are governed by the laws of the State of Maine, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Kennebec County, Maine, and you consent to personal jurisdiction in those courts.
13. Changes to these Terms
We may revise these Terms from time to time. The "Effective date" above reflects the most recent version. We will notify customers of material changes by email or by a prominent notice on the Service. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
